TUNG HEALTH – Terms & Conditions

These Terms of Use govern the use of the TUNG Health mobile application and related services.

Welcome to TUNGHEALTH (“App”). TUNGHEALTH (“Tung Health”, “TungScan”, “Lumi”, “Lumi Ai”, “Tung,” “we,” “our,” or “us”) provides AI-powered wellness insights based on images of the user’s tongue. By accessing or using TungScan, you agree to the following Terms & Conditions.

If you do not agree with these terms, do not use the App.

1. Eligibility

You must be at least 18 years old, or a parent/guardian must provide consent for minors using the App under a Family Profile.

2. Wellness-Only Purpose

TUNGHEALTH provides general wellness insights only.
TUNGHEALTH :

  • Does not provide medical diagnoses

  • Does not replace a healthcare professional

  • Should not be used for urgent, serious, or emergency medical situations

Always consult a qualified healthcare provider for medical concerns.

3. Subscription & Purchases

TUNGHEALTH offers the following purchase options:

  • One-time scan purchases

  • Subscription plans (Standard, Premium)

  • Lifetime access

  • Optional add-on features

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.

Your account will be charged for renewal within 24 hours prior to the end of the current period.

Subscriptions may be managed and canceled through your Apple App Store or Google Play account settings.

Deleting the App does not cancel an active subscription.

All payments and refunds are handled by Apple or Google according to their respective policies.

4. User Responsibilities

You agree to:

  • Provide accurate images and information

  • Use the App for lawful purposes

  • Not misuse, reverse engineer, or disrupt the App

  • Not upload harmful, offensive, or illegal content

5. Intellectual Property

TUNGHEALTH , Lumi, the AI-generated insights, interface, algorithms, branding, and design are protected intellectual property owned by JEM613, LLC.

You may not copy, modify, or distribute any part of the App without written permission.

6. Data & Privacy

Your use of the App is governed by the TUNGHEALTH Privacy Policy, available at:

https://tonguesense.com/privacy

Tongue images are used for wellness analysis and algorithm improvement.
You may delete your data or account at any time.

7. Account Termination

We may suspend or terminate accounts that:

  • Violate these Terms

  • Abuse the platform

  • Engage in fraudulent or harmful behavior

8. Liability Disclaimer

TUNGHEALTH is provided “as-is” without warranties.
We are not liable for:

  • Misinterpretation of insights

  • Decisions made based on the App

  • Technical issues or downtime

  • Loss of data, purchases, or access

  • Health outcomes

9. Modifications to Terms

We may update these Terms periodically.
Your continued use of the App constitutes acceptance of the updated terms.
