TUNG HEALTH – Terms of Service

PLEASE READ THESE TERMS CAREFULLY. THESE TERMS CONTAIN A MANDATORY INDIVIDUAL ARBITRATION PROVISION IN SECTION 23(A) AND A CLASS ACTION/JURY TRIAL WAIVER PROVISION IN SECTION 23(D) THAT REQUIRE THE EXCLUSIVE USE OF FINAL AND BINDING ARBITRATION ON AN INDIVIDUAL BASIS TO RESOLVE DISPUTES BETWEEN YOU AND US.

1. General Terms of Use and Restrictions on Use

Subject to these Terms, Tung Health grants you a limited, revocable, nonexclusive, nontransferable personal right to access and make use of the Tung Health Platform solely for your benefit and no other commercial purpose. We may discontinue or alter any aspect of the Tung Health Platform or remove content from the Tung Health Platform at any time without prior notice. You agree that we may, under certain circumstances, immediately suspend or terminate your access to or use of the Tung Health Platform or any part thereof. Such circumstances include, without limitation: (a) breaches or violations of these Terms or other incorporated agreements or guidelines; (b) discontinuance or material modification to the Tung Health Platform; (c) unexpected technical or security issues or problems; (d) extended periods of inactivity; or (e) engagement by you in fraudulent, inappropriate or illegal activities.

2. Account

While Users may browse the Website without creating an Account, each User will need to have an Account and agree to these Terms in order to use certain features of the Tung Health Platform, including the App(s). To create an account, you will be required to provide certain information, including some Personal Information, such as your name and email address (an "Account").

3. Connecting Via Third-Party Services

By connecting to the Tung Health Platform via a third-party service (such as Google Sign-In or Sign in with Apple), you give us permission to access and use your information from that service as permitted by that service and as described in our Privacy Notice.

4. Account Security

You are responsible for maintaining the confidentiality of your password and/or any other authentication credentials associated with your Account and are fully responsible for all activities that occur under your Account. You are prohibited from sharing your Account with, or assigning your Account to, any other person without our prior written authorization. We encourage you to use "strong" passwords (passwords that use a combination of upper- and lower-case letters, numbers, and symbols) to protect your Account.

5. Service Fees, Billing, and Subscriptions

a. Service Fees

Certain aspects of the Tung Health Platform may be provided for free (including basic tongue scans with color, coating, hydration, and stress insights), while certain other aspects may be provided for a fee ("Fee"). These include Premium Scans, Subscriptions, and physical products from the Tung Health Wellness Store. By electing to use non-free aspects of the Tung Health Platform, you agree to the pricing and payment terms applicable to you.

b. Definitions

"Subscription" means a recurring membership to the Tung Health Platform that grants access to unlimited premium scans, weekly wellness plans, full trend dashboards, L.U.M.I. chat, and exclusive insights. "Subscription Fee" means the recurring amount due as consideration for a Subscription. "Premium Scan" means a one-time purchase that unlocks advanced wellness insights including vitamin indicators, gut score, detailed organ-zone mapping, and stress index for a single scan. "Payment Processor" means the third-party payment processor we engage to process payments, currently Stripe, Inc., or Apple, Inc. ("Apple") for any payments made through the App acquired from the Apple App Store.

c. Your Payment Method

To use non-free aspects of the Tung Health Platform, you must provide at least one current, valid payment method accepted by us and Payment Processor. By providing a Payment Method, you authorize each of Tung Health and Payment Processor to charge that Payment Method the applicable Fees and Taxes, including, if applicable, on a recurring basis until you cancel your Subscription.

d. Automatic Renewals

YOUR SUBSCRIPTION WILL AUTOMATICALLY RENEW AT THE END OF EACH SUBSCRIPTION TERM UNLESS AND UNTIL YOU CANCEL THE APPLICABLE SUBSCRIPTION IN ACCORDANCE WITH THE CANCELLATION PROCEDURES IDENTIFIED BELOW. YOU UNDERSTAND THAT UNLESS AND UNTIL YOU NOTIFY US OF YOUR INTENT TO CANCEL, YOUR SUBSCRIPTION AND THE CORRESPONDING SUBSCRIPTION FEE WILL AUTOMATICALLY RENEW.

e. Cancellation Procedures

You may cancel your Subscription at any time by logging into your Account, contacting us at support@tunghealth.ai, or through Apple (as may be applicable to you). Should you cancel your Subscription before the end of the applicable Subscription Term, you will have access to your Subscription features and services until the end of that Subscription Term.

f. Refunds

YOU UNDERSTAND AND ACKNOWLEDGE THAT, UNLESS REQUIRED BY APPLICABLE LAW, YOU WILL NOT BE ENTITLED TO RECEIVE ANY REFUND OR CREDIT FOR ANY CANCELLATION, SUSPENSION, OR TERMINATION, NOR FOR ANY UNUSED TIME ON YOUR SUBSCRIPTION, ANY PRE-PAYMENTS MADE IN CONNECTION WITH YOUR SUBSCRIPTION, ANY USAGE OR SUBSCRIPTION FEES FOR ANY PORTION OF THE TUNG HEALTH PLATFORM, ANY CONTENT OR DATA ASSOCIATED WITH YOUR ACCOUNT, OR ANYTHING ELSE. If you believe you have been improperly charged and would like to request a refund, please contact us at support@tunghealth.ai, or Apple (as may be applicable to you).

g. Payment Disclaimer

WE DISCLAIM ANY AND ALL LIABILITY WITH RESPECT TO, AND YOU UNDERSTAND AND ACKNOWLEDGE THAT WE ARE NOT RESPONSIBLE FOR: (I) ANY SECURITY OR PRIVACY BREACHES RELATED TO YOUR CREDIT CARD OR OTHER PAYMENT METHOD, (II) ANY FEES THAT MAY BE CHARGED TO YOU BY YOUR BANK IN CONNECTION WITH THE COLLECTION OF FEES, AND/OR (III) ANY UNAUTHORIZED USE OF YOUR CREDIT CARD, DEBIT CARD, OR OTHER PAYMENT METHOD BY A THIRD PARTY.

6. Your Use of Third-Party Services

The Tung Health Platform may provide links to other websites or resources maintained by third parties (collectively, "Third-Party Services"). You agree that we have no control over and are not responsible for the content or availability of such websites or resources. IF YOU USE A THIRD-PARTY SERVICE IN CONNECTION WITH THE TUNG HEALTH PLATFORM, YOU ARE SUBJECT TO AND AGREE TO, AND MUST COMPLY WITH, THE THIRD PARTY'S TERMS AND CONDITIONS. WE DO NOT ENDORSE OR ASSUME ANY RESPONSIBILITY FOR ANY THIRD-PARTY SERVICES.

7. Privacy

Your privacy is important to us. Please carefully review our Privacy Notice located at https://tungscan.com/privacy-policy for information about how Tung Health may collect, use, store, or share information from you. Data we collect includes: tongue images, scan metadata, device information, and optional email addresses. We do not sell user data, share images for advertising, or make medical assessments. Your tongue images are processed by Google AI (Gemini) solely for image quality verification and to generate descriptive wellness narratives from on-device scores.

8. Feedback

We welcome your Feedback. You may be prompted to submit comments, suggestions, ideas, feedback, ratings, materials, or other information ("Feedback") to us through the Tung Health Platform. You hereby agree that all Feedback that you disclose or submit to us through the Tung Health Platform is voluntary, non-confidential, and becomes and remains our property. You hereby assign to Tung Health all rights (including all Intellectual Property Rights), title, and interest in and to the Feedback.

9. Prohibited Uses

You agree to use the Tung Health Platform and related services only for lawful purposes and to follow all applicable local, state, national, and international laws, rules, and regulations ("Applicable Law"). While using the Tung Health Platform, except to the extent a restriction is prohibited by Applicable Law, you agree that you will not:

  • •License, sublicense, sell, resell, transfer, assign, distribute, or otherwise commercially exploit or make available to any third party any portion of the Tung Health Platform or Content;

  • •Copy, modify, adapt, alter, translate, create derivative works, reverse engineer, decompile, disassemble, or otherwise attempt to learn the source code, structure, scoring algorithms, or ideas upon which the Tung Health Platform is based;

  • •Submit, upload, or transmit non-tongue images, images of other people's tongues, synthetic or AI-generated tongue images, or any other fraudulent imagery for the purpose of obtaining wellness insights;

  • •Misrepresent, redistribute, or present Tung Health wellness insights, scores, or narratives as medical diagnoses, professional health assessments, or clinical advice to any third party;

  • •Promote illegal activities, sexual or "adult" conduct, child abuse, drugs, or anything objectionable (as determined by us) or otherwise violate any applicable law;

  • •Use the Tung Health Platform to post, use, upload, or disseminate content that infringes or misappropriates any intellectual property rights or proprietary right of any party;

  • •Take any action to circumvent, compromise, or defeat any security measures implemented on any part of the Tung Health Platform;

  • •Use any manual or automated software, devices, or other processes to "crawl" or "spider" any web pages contained in the Tung Health Platform;

  • •Frame or otherwise simulate the appearance or functions of the Tung Health Platform;

  • •Use the Tung Health Platform to gain competitive intelligence about us or develop a competing platform or service;

  • •Use the Tung Health Platform to post, store, or disseminate any unsolicited or unauthorized advertising, promotional materials, junk mail, spam, or pyramid schemes;

  • •Harvest or otherwise collect information about other Users; or

  • •Authorize or assist a third party to do any of the foregoing.

10. User Contributions

Users may post, submit, publish, display, or transmit to other Users or other persons information or materials (collectively, "User Contributions") on or through the Tung Health Platform, including tongue scan images. By providing any User Contribution on the Tung Health Platform, you grant us and our respective licensees, successors and assigns the irrevocable, perpetual, transferable, sublicensable, fully paid, royalty-free, and worldwide right and license to use, reproduce, modify, perform, display, distribute and otherwise disclose to third parties any such material. You represent and warrant that: • You own or control all rights in and to the User Contributions; • All of your User Contributions do and will comply with these Terms; • Your User Contributions will not violate any Applicable Law or infringe any rights of any third party; • Your User Contributions do not include any information that a governmental body deems to be sensitive or classified information.

11. Contribution Standards

These contribution standards ("Contribution Standards") apply to any and all User Contributions. User Contributions must in their entirety comply with all applicable laws and regulations. Without limiting the foregoing, User Contributions must not:

  • •Contain any material which is defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory, or otherwise objectionable;

  • •Promote sexually explicit or pornographic material, violence, or discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age;

  • •Infringe any patent, trademark, trade secret, copyright, or other intellectual property or other rights of any other person;

  • •Be likely to deceive any person;

  • •Promote any illegal activity, or advocate, promote, or assist any unlawful act;

  • •Impersonate any person, or misrepresent your identity or affiliation with any person or organization; or

  • •Give the impression that they emanate from or are endorsed by us or any other person or entity, if this is not the case.

12. Monitoring and Enforcement

Tung Health reserves the right to: • Remove or refuse to post any User Contributions for any or no reason in our sole discretion; • Take any action with respect to any User Contribution that we deem necessary or appropriate; • Take appropriate legal action, including referral to law enforcement, for any illegal or unauthorized use of the Tung Health Platform; and • Terminate or suspend your access to all or part of the Tung Health Platform for any or no reason, including any violation of these Terms.

13. Intellectual Property Rights

"Intellectual Property Rights" means all patent rights, copyright rights, mask work rights, moral rights, rights of personality, trademark, trade dress and service mark rights, goodwill, trade secret rights, and any and all other intellectual property rights and proprietary rights. All content and materials on the Tung Health Platform (excluding your User Contributions), such as text, graphics, logos, images, audio clips, digital downloads, data compilations, software, scoring algorithms, wellness narratives, or other material ("Content") is the property of Tung Health or its third party licensors and is protected by United States and international intellectual property laws.

14. Output

Subject to your compliance with these Terms, you may use your output of the Tung Health Platform ("Output") — including wellness scores, AI-generated narratives, organ-zone maps, trend data, daily and weekly plans, and supplement recommendations — for any lawful purpose, on a royalty-free basis, provided that you acknowledge and agree: (i) that your use of the Tung Health Platform and the Output does not transfer to you ownership of any Intellectual Property Rights in the Tung Health Platform and that (ii) we may limit your use of the Output or require you to cease using them. You shall not represent that Output was human-generated or use the Output to train your own machine learning models. DUE TO THE NATURE OF MACHINE LEARNING, THE OUTPUT MAY NOT BE UNIQUE ACROSS USERS AND THE TUNG HEALTH PLATFORM MAY GENERATE THE SAME OR SIMILAR OUTPUT FOR OTHER USERS. USE OF THE SERVICE MAY RESULT IN INCORRECT OUTPUT THAT DOES NOT ACCURATELY REFLECT REALITY. YOU MUST EVALUATE THE ACCURACY OF ANY OUTPUT AS APPROPRIATE FOR YOUR USE CASE, INCLUDING BY USING HUMAN REVIEW OF THE OUTPUT.

15. Usage Data

We may collect, or you may provide to us, diagnostic, technical, usage, and/or related information, including information about your computers, mobile devices, systems, and software (collectively, "Usage Data"). All Usage Data is and will be owned solely and exclusively by us. Accordingly, we may use, maintain, and/or process the Usage Data for any lawful purpose, including: • To provide and maintain the Tung Health Platform; • To improve our products and services and develop new products, services, and features; • To monitor your usage of the Tung Health Platform; • For research and analytics, including data analysis, identifying usage trends, and customer research; and • To share analytics and other derived Usage Data with third parties, solely in de-identified or aggregated form.

16. AI Processing and Wellness Insights

a. Two-Step Wellness Pipeline

The Tung Health Platform uses a two-step process to generate your wellness insights. First, your wellness scores are computed on-device using Tung Health's proprietary deterministic scoring engine, which analyzes 14 numeric features extracted from your tongue image using standard image processing techniques. Second, Google AI (Gemini) receives your tongue image alongside the on-device scores to generate descriptive wellness narratives. This two-step process ensures you receive accurate, consistent lifestyle insights.

b. Image Processing

When you take a scan, your tongue image is briefly sent to Google AI (Gemini) to: (i) confirm the captured photo is a valid tongue image, and (ii) generate descriptive narratives from your on-device scores. No personal information is sent alongside the image. Google does not store your images, does not use images for AI training, and does not share images with third parties.

c. L.U.M.I. Wellness Guide

L.U.M.I. is Tung Health's AI-powered wellness guide that interprets your scan results, encourages daily scanning habits, and helps you understand your wellness patterns. L.U.M.I. provides wellness-oriented guidance only and does not provide medical advice.

17. Wellness Disclaimer; No Medical Advice

Tung Health promotes healthy awareness of wellness patterns through tongue analysis and provides Users with certain tools intended to assist Users in achieving their personal wellness goals. However, the Tung Health Platform is offered for educational, informational, and communicative purposes only, and does not offer professional or medical advice. TUNG HEALTH PROVIDES LIFESTYLE PATTERN OBSERVATIONS AND WELLNESS INDICATORS ONLY. THIS IS NOT MEDICAL ADVICE. THE INFORMATION CONTAINED ON THE TUNG HEALTH PLATFORM IS NOT MEDICAL ADVICE. THE INFORMATION MADE AVAILABLE THROUGH THE TUNG HEALTH PLATFORM DOES NOT CREATE A MEDICAL PROFESSIONAL OR PATIENT RELATIONSHIP BETWEEN TUNG HEALTH AND YOU. NONE OF THE SERVICES OR INFORMATION PROVIDED THROUGH THE TUNG HEALTH PLATFORM ARE INTENDED AS A SUBSTITUTE FOR, NOR DOES IT REPLACE, ANY PROFESSIONAL ADVICE, DIAGNOSIS, OR TREATMENT. FOR MEDICAL QUESTIONS, CONSULT A HEALTHCARE PROVIDER.

18. Supplements and Physical Products

a. Wellness Store

The Tung Health Platform may include a wellness store offering physical products such as supplements, hydration boosters, stress-calming formulas, gut restore probiotics, liver detox support, vitamin blends, anti-inflammatory support, and wellness bundles. Product recommendations may be personalized based on your scan trends. All products are provided by third-party suppliers and are subject to availability.

b. Supplement Disclaimer

SUPPLEMENTS AND PHYSICAL PRODUCTS SOLD THROUGH THE TUNG HEALTH PLATFORM ARE NOT INTENDED TO DIAGNOSE, TREAT, CURE, OR PREVENT ANY DISEASE. ALWAYS CONSULT YOUR HEALTHCARE PROVIDER BEFORE STARTING ANY NEW SUPPLEMENT REGIMEN, ESPECIALLY IF YOU ARE PREGNANT, NURSING, HAVE A MEDICAL CONDITION, OR ARE TAKING MEDICATION.

c. Supplement Refund Policy

Refunds for physical products are available for: damaged items upon delivery, wrong item shipped, and missing or lost packages. Refund requests must be submitted within 30 days of delivery via orders@tunghealth.ai. Please include your order number and photos of any damage.

19. Disclaimer

THE TUNG HEALTH PLATFORM IS PROVIDED "AS IS" AND ON AN "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE HEREBY EXPRESSLY DISCLAIM ALL REPRESENTATIONS AND WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. YOUR USE OF THE PLATFORM IS AT YOUR SOLE RISK. WE MAKE NO REPRESENTATION OR WARRANTY (A) THAT THE PLATFORM WILL MEET YOUR REQUIREMENTS; (B) THAT THE PLATFORM WILL BE ERROR-FREE OR UNINTERRUPTED; (C) REGARDING THE SECURITY, RELIABILITY, ACCURACY, TIMELINESS, OR PERFORMANCE OF THE PLATFORM; (D) THAT ANY ERRORS OR DEFECTS WILL BE CORRECTED; OR (E) THAT ANY CONTENT, MATERIAL, INFORMATION, OR DATA OBTAINED BY YOU THROUGH THE TUNG HEALTH PLATFORM IS ACCURATE OR RELIABLE.

20. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU EXPRESSLY UNDERSTAND AND AGREE THAT TUNG HEALTH SHALL NOT BE LIABLE FOR ANY INJURY YOU MAY SUSTAIN OR ANY DIRECT, INDIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL, PUNITIVE OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF YOUR USE OF OR INABILITY TO USE THE TUNG HEALTH PLATFORM. IN NO EVENT SHALL TUNG HEALTH'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, CLAIMS, AND CAUSES OF ACTION EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING OR USING THE TUNG HEALTH PLATFORM.

21. Termination

These Terms are effective upon your acceptance and will continue in full force until terminated. You agree that Tung Health may terminate your use of the Tung Health Platform, or any part thereof, or remove, discard, or discontinue providing any Content, without notice. You may terminate these Terms at any time by discontinuing your use of the Tung Health Platform. You may request deletion of your account and all associated data (including tongue images, scan history, and wellness data) at any time by contacting privacy@tunghealth.ai.

22. Release and Indemnification

You agree to release Tung Health, its members, officers, directors, employees, and agents from any and all liability and obligations whatsoever in connection with or arising out of your use of the Tung Health Platform. If, at any time, you are not satisfied with the Tung Health Platform, your sole remedy is cessation of use. You agree to defend, indemnify, and hold harmless Tung Health from and against any and all claims, actions, demands, obligations, losses, liabilities, expenses, and costs, including reasonable attorneys' fees, arising from (a) your access or use of the Tung Health Platform; (b) breach of these Terms; (c) infringement or misappropriation of any intellectual property or other rights; or (d) any negligence or willful misconduct by you.

23. Arbitration and Class Action/Jury Trial Waiver

THIS SECTION AFFECTS YOUR RIGHTS AND REQUIRES THE PARTIES TO ARBITRATE THEIR DISPUTES — PLEASE READ CAREFULLY.

a. Arbitration Agreement

This Arbitration Agreement applies to and governs any dispute, controversy, or claim between you and us that arises out of or relates to these Terms, access to or use of the Tung Health Platform, any transactions through the Tung Health Platform, or any other aspect of your relationship with us as a User.

b. Opting Out of Arbitration Agreement

If you are a new User, you can reject and opt out of this Arbitration Agreement within thirty (30) days of accepting these Terms by emailing us at support@tunghealth.ai with your full, legal name and stating your intent to opt out. Opting out does not affect the binding nature of any other part of these Terms.

c. Dispute-Resolution Process

For any Claim, you will first contact us at support@tunghealth.ai and attempt to resolve the Claim informally. If we have not been able to resolve a Claim after sixty (60) days, we each agree to resolve such Claim through binding arbitration by JAMS before a single arbitrator, under the Optional Expedited Arbitration Procedures. The arbitration will be conducted in the U.S. county where you live or Travis County, Texas.

d. No Class Action

YOU AGREE THAT ANY CLAIM YOU MAY HAVE AGAINST US MAY ONLY BE BROUGHT INDIVIDUALLY AND YOU WILL NOT JOIN SUCH CLAIM WITH CLAIMS OF ANY OTHER PERSON OR ENTITY OR BRING, JOIN, OR PARTICIPATE IN A CLASS ACTION AGAINST US. BY ACCEPTING THESE TERMS, YOU AND TUNG HEALTH ARE EACH WAIVING THE RIGHT TO PARTICIPATE IN OR BRING A CLASS ACTION.

e. Severability

If any part of this Arbitration Agreement is deemed to be invalid, unenforceable, or illegal, it will be severed. Severance will have no impact on the remaining provisions of this Arbitration Agreement.

f. Equitable Relief

NOTHING IN THIS ARBITRATION AGREEMENT WILL BE DEEMED AS PREVENTING US FROM SEEKING INJUNCTIVE OR OTHER EQUITABLE RELIEF FROM THE COURTS AS NECESSARY TO PREVENT THE ACTUAL OR THREATENED INFRINGEMENT OF OUR INTELLECTUAL PROPERTY RIGHTS; OR PREVENTING YOU FROM ASSERTING CLAIMS IN A SMALL CLAIMS COURT, PROVIDED THAT YOUR CLAIMS QUALIFY.

24. Governing Law

You agree that the laws of the State of Texas, without giving effect to any principles of conflicts of law, govern these Terms and any dispute that may arise between you and us. The Federal Arbitration Act (9 U.S.C. §§1-16) governs the interpretation and enforcement of the Arbitration Agreement. You agree to submit to the exclusive personal jurisdiction of the federal and state courts located in Texas.

25. Confidential Information

The Tung Health Platform may include non-public, proprietary, or confidential information of Tung Health and/or of other Users ("Confidential Information"). You will: (a) protect and safeguard the confidentiality of all Confidential Information with at least the same degree of care as you would use to protect your own highly sensitive confidential information; (b) not use any Confidential Information for any purpose other than to exercise your rights under these Terms; and (c) not disclose any Confidential Information to any person or entity, except as required by law.

26. Notice of Copyright Infringement

We respect content owners' rights, and it is our policy to respond to alleged infringement notices that comply with the Digital Millennium Copyright Act of 1998 ("DMCA"). If you believe that the Tung Health Platform contains any content that infringes your copyrights, please provide our Designated Copyright Agent with the required information at: support@tunghealth.ai

27. Export

You understand and acknowledge that the Tung Health Platform may be subject to export control laws and regulations. You will comply with all applicable import and export and re-export control and trade and economic sanctions laws and regulations.

28. Miscellaneous

a. Entire Agreement

These Terms, including any other terms or agreements referenced herein, constitute the complete and entire agreement between you and us with respect to the Tung Health Platform.

b. No Waiver

No waiver by either Party of any breach of these Terms shall be deemed to be, or construed as, a further or continuing waiver of any other such breach.

c. Modification

We may, in our sole discretion, modify or update these Terms from time to time. When we change these Terms in a material manner, we will update the "last modified" date at the top of this page. Your continued access or use of the Tung Health Platform after the Terms have been revised constitutes your express consent to the modified Terms.

d. California Residents

29. Additional Terms for Apps

a. General

To use any App, you must have a mobile device that is compatible with such App. We hereby grant you a non-exclusive, limited, non-transferable, and freely revocable license to use a compiled code copy of the App(s) under your Account on one or more mobile devices owned or controlled solely by you.

b. iOS App

You and Tung Health understand and acknowledge that these Terms are solely between you and Tung Health, not Apple, and that Apple has no responsibility for the iOS App or content thereof. Your access to and use of the iOS App must comply with the usage rules set forth in Apple's then-current Apple Media Services Terms and Conditions.
